Premarital agreements are entered into between two parties prior to marriage. A premarital agreement, also known as a pre-nuptial agreement, will address the rights and obligations of each party in any property of either party in the event of a divorce. A premarital agreement becomes effective on the date of marriage. It is imperative that the parties who are entering into a premarital agreement understand the formalities required in entering into a premarital agreement. Each party should be represented by an attorney when entering into such an agreement.
